Filing notice of claim of lien on judgment for sum of money
(1)
When an attorney claims a lien under ORS 87.445 (Attorney’s lien upon actions and judgments), if the judgment is for a sum of money only, the attorney must file a notice of claim of lien with the clerk of the court that entered the judgment within three years after the judgment is entered. The clerk shall enter the notice in the register of the court and in the judgment lien record maintained by the court administrator under ORS 18.075 (Entry of judgments in circuit courts generally).(2)
When an attorney files a notice of claim of lien under subsection (1) of this section, the attorney shall send forthwith a copy of the notice to the client by registered or certified mail sent to the client at the last-known address of the client.(3)
A lien under ORS 87.445 (Attorney’s lien upon actions and judgments) on a judgment for a sum of money only remains a lien on the judgment until the judgment remedies for the judgment expire under ORS 18.180 (Expiration of judgment remedies in circuit court) to 18.190 (Spousal support awards in judgments entered before January 1, 2004).(4)
For purposes of this section, a “judgment for a sum of money only” does not include a judgment or order for the payment of money for the support of any person under ORS 107.095 (Provisions court may make after commencement of suit and before judgment), 107.105 (Provisions of judgment), 108.120 (Support judgment or order), 109.155 (Hearing) or 419B.400 (Authority to order support).
