Prohibitions related to endowment care cemeteries
A person may not, in connection with operating an endowment care cemetery:
(1) Employ any device, scheme or artifice to defraud;
(2) Knowingly make any untrue statement of a material fact or omit stating a material fact necessary in order to make the statements made, in light of the circumstances under which the statements are made, not misleading;
(3) Engage in an act, practice or course of business that operates or would operate as a fraud or deceit upon any person; or
(4) Make or file, or cause to be made or filed, to or with the Director of the Department of Consumer and Business Services, a statement, report or document that is known to be false in any material respect or matter. [2019 c.8 §5]
Note: 97.823 (Prohibitions related to endowment care cemeteries) was added to and made a part of 97.810 (Endowment care and nonendowed care cemeteries) to 97.920 (Judgment declaring nuisance, authorizing abatement and creating and foreclosing lien) by legislative action but was not added to any smaller series therein. See Preface to Oregon Revised Statutes for further explanation.
