Adoption of policies and procedures prior to forfeiture

A law enforcement agency, as defined in ORS 136.595 (How subpoena is served), may not seize a vehicle for forfeiture under ORS 131.602 (Prohibited conduct for purposes of instrumentalities of crime) (132) or (133) or 809.740 (Seizure of motor vehicle for forfeiture), unless the agency has adopted policies and procedures for seizure, including policies relating to when a police officer may seize a motor vehicle for forfeiture under ORS 131.602 (Prohibited conduct for purposes of instrumentalities of crime) (132) or (133) or 809.740 (Seizure of motor vehicle for forfeiture).
