Effect of certain laws on cities and counties

Nothing in ORS 215.203 (Zoning ordinances establishing exclusive farm use zones), 215.213 (Uses permitted in exclusive farm use zones in counties that adopted marginal lands system prior to 1993), 215.283 (Uses permitted in exclusive farm use zones in nonmarginal lands counties), 308A.056 (Definition of "farm use"), 315.141 (Biomass production or collection), 315.144 (Transfer of biomass credit), 469.320 (Site certificate required) and 469B.403 (Biomass):

(1) Supersedes any authority under ORS chapter 459 or 459A for cities and counties to regulate the collection of solid waste; or

(2) Authorizes the collection of solid waste within a city or county without permission of the city or county. [2007 c.739 §39]

Note: 459.109 (Effect of certain laws on cities and counties) was enacted into law by the Legislative Assembly but was not added to or made a part of ORS chapter 459 or any series therein by legislative action. See Preface to Oregon Revised Statutes for further explanation.
