Civil penalties

(1) In addition to any other liability or penalty provided by law, the Oregon Health Authority may impose a civil penalty on a person for violation of:

(a) ORS 453.885 (Decontamination of property); or

(b) ORS 453.005 (Definitions for ORS 453.005 to 453.135) to 453.135 (Notice required prior to institution of criminal proceedings) or rules adopted under ORS 453.005 (Definitions for ORS 453.005 to 453.135) to 453.135 (Notice required prior to institution of criminal proceedings) by the authority.

(2) A civil penalty imposed under this section may not exceed $2,000.

(3) ORS 183.745 (Civil penalty procedures) applies to civil penalties imposed under this section. [1999 c.861 §7; 2005 c.496 §5; 2009 c.595 §936]
