Compelling adoption of resolution
(1) Any person who may be adversely affected by the failure of a county court to adopt a resolution as required by ORS 431.715 (Resolution requesting Oregon Health Authority to initiate formation or annexation) (1) may seek to compel the adoption of such resolution through a writ of mandamus under ORS 34.105 (Definitions for ORS 34.105 to 34.240) to 34.240 (Appeal).
(2) The prevailing party in a proceeding under ORS 34.105 (Definitions for ORS 34.105 to 34.240) to 34.240 (Appeal) authorized by subsection (1) of this section is entitled to reasonable attorney fees in addition to costs and necessary disbursements. [1981 c.888 §6]
