Immunity of employer reporting abuse by employee

A person who has personal knowledge that an employee or former employee of the person was found by the Department of Human Services or a law enforcement agency to have committed abuse under ORS 430.735 (Definitions for ORS 430.735 to 430.765) to 430.765 (Duty of officials to report abuse), is immune from civil liability for the disclosure to a prospective employer of the employee or former employee of known facts concerning the abuse. Note: 430.756 (Immunity of employer reporting abuse by employee) was enacted into law by the Legislative Assembly but was not added to or made a part of ORS chapter 430 or any series therein by legislative action. See Preface to Oregon Revised Statutes for further explanation.
