When limitation on liability not applicable

Nothing in ORS 30.492 (Limitation on liability of volunteer providing assistance or advice related to mitigation or cleanup of discharge of hazardous material) shall be construed to limit or otherwise affect the liability of any person for damages resulting from the person’s gross negligence or from the person’s reckless, wanton or intentional misconduct.
