Interpretation of membership camping contracts
  • application of Unlawful Trade Practices Act

(1) Membership camping contracts, campgrounds and facilities are not subdivisions or series partitions under ORS chapter 92, are not condominiums under ORS chapter 100, are not timeshare properties under ORS chapter 94, and are not securities under ORS 59.005 (Short title) to 59.451 (Prohibition against filing false statement by person under investigation or examination), 59.710 (Definitions for ORS 59.710 to 59.830) to 59.830 (Self-incrimination by witness), 59.991 (Criminal penalties for ORS 59.005 to 59.451 and 59.710 to 59.830) and 59.995 (Civil penalties for ORS 59.005 to 59.451 and 59.710 to 59.830).

(2) Membership camping contracts covered by ORS 94.925 (Civil penalty) to 94.983 (Cancellation of contract by purchaser) are retail installment contracts under ORS 83.010 (Definitions for ORS 83.010 to 83.190) to 83.190 (Civil penalties).

(3) The Attorney General shall protect the rights of purchasers through the application of ORS 646.605 (Definitions for ORS 646.605 to 646.652) to 646.652 (District attorney's reports to Attorney General). [1985 c.639 §12]
