Expert witness exception

The licensing requirement of ORS 703.405 (License requirement) does not apply to a person while the person is:

(1) Providing testimony in a court as an expert under ORS 40.410 (Rule 702. Testimony by experts); or

(2) Conducting investigations or reviews or engaging in other activities in preparation for providing testimony in a court as an expert under ORS 40.410 (Rule 702. Testimony by experts). [2003 c.687 §14; 2005 c.613 §10]

Note: 703.407 (Expert witness exception) was enacted into law by the Legislative Assembly but was not added to or made a part of ORS chapter 703 or any series therein by legislative action. See Preface to Oregon Revised Statutes for further explanation.

In prison disciplinary hearing, introduc­tion of actual ques­tions asked prisoner during polygraph examina­tion, re­gard­ing his involve­ment in alleged assault, constituted sufficient founda­tion for admission of record of polygraph test and conclusions of general polygraph examiner, notwithstanding that prisoner's verbal answers were not recorded or introduced.
