Penalties

(1) Violation of ORS 618.086 (Orders restricting distribution of weights and measures), 618.096 (Prohibited acts involving commercial weights and measures), 618.121 (License required for commercially operated weighing or measuring instrument) or 618.201 (Sampling of packages and commodities) is punishable as follows:

(a) If the violator is an individual, by imprisonment for not more than six months, or a fine not to exceed $500, or both.

(b) If the violator is a person other than an individual, by a fine of not more than $2,500.

(2) For the purposes of this section, each day of violation of ORS 618.086 (Orders restricting distribution of weights and measures), 618.096 (Prohibited acts involving commercial weights and measures), 618.121 (License required for commercially operated weighing or measuring instrument) or 618.201 (Sampling of packages and commodities) is a separate offense and the penalties provided in subsection (1) of this section apply to each such offense.
