Department investigation of alleged weights and measures law violations

(1) The State Department of Agriculture shall investigate complaints made to it concerning violations of ORS 618.010 (Definitions) to 618.246 (Sale by weight required for certain food products) and, upon its own initiative, shall conduct such investigations as it considers appropriate to develop information relating to prevailing procedures in commercial quantity determination and relating to possible violations of ORS 618.010 (Definitions) to 618.246 (Sale by weight required for certain food products), and in order to promote the general objective of accuracy in the determination and representation of quantity in commercial transactions.
(2) ORS 618.010 (Definitions) to 618.246 (Sale by weight required for certain food products) do not apply to meters for the measurement of electricity, gas or water when operated in a system of a public utility, as defined in ORS 757.005 (Definitions), or to any associated appliances or accessories.
