(1) Except where other punishment is specifically provided for, violation of any provision of this chapter and ORS 474.105 (Legislative finding on ORS 474.115) and 474.115 (Wholesale sale of malt beverage subject to agreement designating territory of sale) is a misdemeanor.
(2) Except as otherwise specifically provided, municipal, justice and circuit courts have concurrent jurisdiction of all violations of this chapter and ORS 474.105 (Legislative finding on ORS 474.115) and 474.115 (Wholesale sale of malt beverage subject to agreement designating territory of sale) committed within their respective jurisdictions.
(3) A second or subsequent violation of ORS 471.440 (Manufacture, fermentation or possession of mash, wort or wash) is punishable upon conviction by imprisonment in the custody of the Department of Corrections for not more than three years and by a fine of not more than $3,000.
(4) Subject to ORS 153.022 (Authority of agency to specify rule violation as particular level of violation), violation of any regulation promulgated under ORS 471.730 (Regulatory powers of commission) (5) is a Class C violation.
