Unlawful air pollution in the second degree
(1) A person commits the crime of unlawful air pollution in the second degree if the person knowingly violates any applicable requirement of ORS chapter 468A or a permit, rule or order adopted or issued under ORS chapter 468A.
(2) Notwithstanding ORS 161.515 ("Crime" described) and subject to ORS 153.022 (Authority of agency to specify rule violation as particular level of violation), unlawful air pollution in the second degree is a criminal offense punishable solely by a fine of up to $10,000.
