Prohibition on providing application
  • escrow agent fees
  • action for damages

(1) An escrow agent may not provide an application to the Department of Consumer and Business Services under ORS 446.591 (Exception to requirement for submitting information) (5) if the agent has received a written objection in response to the notice provided under ORS 446.596 (Notice provided by escrow agent).

(2) An escrow agent may charge the person owning the manufactured structure under the replacement ownership document a reasonable fee for services provided in compliance with ORS 446.591 (Exception to requirement for submitting information) and 446.596 (Notice provided by escrow agent).

(3) In addition to any other remedy provided by law, a person may bring an action against an escrow agent for damages sustained by the person due to the negligence or willful misconduct of the escrow agent in complying with ORS 446.591 (Exception to requirement for submitting information) and 446.596 (Notice provided by escrow agent).
