(2) A state agency shall inform the Oregon Department of Administrative Services of any position that has remained vacant for a continuous period of six months by including a report on the position in the estimate submitted to the department under ORS 291.242 (Allotment required before expenditure of appropriation). The department may consider the vacancy in its determinations under ORS 291.244 (Department action on estimates) and may reduce the amount allotted to the state agency. Note: 291.263 (Vacant positions) was enacted into law by the Legislative Assembly but was not added to or made a part of ORS chapter 291 or any series therein by legislative action. See Preface to Oregon Revised Statutes for further explanation.
