Reservation of new lands
Notwithstanding ORS 274.905 (Definitions for ORS 274.905 to 274.940), 274.915 (Lease or disposal of new lands) to 274.925 (Right of public riparian owner to purchase new lands), 274.929 (Right of nonpublic riparian owner to purchase certain new lands), 274.932 (Right of public body to purchase new lands created by it) and 274.937 (Right of individual to purchase new lands created by individual), the Department of State Lands may reserve new lands from sale, transfer or lease where upon notice and hearing it determines that the public interest requires such lands to be preserved for recreation, conservation of fish and wildlife or the development of navigation facilities, but in case of such reservation the adjoining or opposite upland or riparian owner shall be allowed reasonable access across such reserved new lands to navigable water.
