Following the entry of a judgment pursuant to ORS 161.319 (Form of verdict on guilty except for insanity) and the dispositional determination under ORS 161.325 (Entry of judgment of guilty except for insanity), if the court finds that the person would have been guilty of a misdemeanor during a criminal episode in the course of which the person did not cause physical injury or risk of physical injury to another, and if the court has probable cause to believe that the person is dangerous to self or others as a result of a mental disorder, the court may initiate civil commitment proceedings under ORS 426.070 (Initiation) to 426.130 (Court determination of mental illness).
