Alternative proof of certain victims of aggravated murder

Notwithstanding ORS 163.095 ("Aggravated murder" defined), when an element of a crime charged is that the victim of the crime is a police officer as defined in ORS 181A.355 (Definitions for ORS 181A.355 to 181A.670) and the crime was related to the officer’s performance of official duties, the state may alternatively prove that the victim of the crime is a certified reserve officer or a reserve officer, as those terms are defined in ORS 181A.355 (Definitions for ORS 181A.355 to 181A.670), and the crime was related to the officer’s performance of official duties. Note: 163.098 (Alternative proof of certain victims of aggravated murder) was enacted into law by the Legislative Assembly but was not added to or made a part of ORS chapter 163 or any series therein by legislative action. See Preface to Oregon Revised Statutes for further explanation.
