2015 ORS 161.615¹
Prison terms for misdemeanors

Sentences for misdemeanors shall be for a definite term. The court shall fix the term of imprisonment within the following maximum limitations:

(1) For a Class A misdemeanor, 1 year.

(2) For a Class B misdemeanor, 6 months.

(3) For a Class C misdemeanor, 30 days.

(4) For an unclassified misdemeanor, as provided in the statute defining the crime. [1971 c.743 §75]

Notes of Decisions

Because sentencing guidelines do not apply to misdemeanor convictions, trial court did not err by requiring defendant to serve consecutive misdemeanor sentences after serving prison term for felony conviction. State v. Miller, 114 Or App 235, 835 P2d 131 (1992)

Notes of Decisions

A juvenile court adjudication of whether or not a child committed acts which would be a criminal violation if committed by an adult must necessarily include an adjudication of all affirmative defenses that would be available to an adult being tried for the same criminal violation.
