Effect of waiver of right to jury trial

When a defendant waives the right to a jury trial on the issue of guilt or innocence, the waiver constitutes a written waiver of the right to a jury trial on all enhancement facts whether related to the offense or the defendant. [2005 c.463 §5]

To waive constitu­tional right to jury trial on ques­tion of guilt or innocence, defendant must also make knowing and inten­tional waiver, in writing, of right to jury trial on sen­ten­cing enhance­ment facts. State v. Lafferty, 240 Or App 564, 247 P3d 1266 (2011)
