Rulemaking authority

(1) In accordance with applicable provisions of ORS chapter 183, the Director of the Oregon Health Licensing Agency may adopt rules necessary for the administration of the laws that the Oregon Health Licensing Agency is charged with administering.

(2) In accordance with applicable provisions of ORS chapter 183, the director may adopt rules necessary for the administration of ORS 676.605 (Purpose of Oregon Health Licensing Agency) to 676.625 (Oregon Health Licensing Agency Account) and 676.992 (Civil penalties).

(3) The agency may adopt rules establishing requirements for placement of a certificate, license, permit or registration issued by the agency in a dormant status upon application by the holder and establishing conditions for reactivation of the certificate, license, permit or registration.

(4) Pursuant to ORS 676.605 (Purpose of Oregon Health Licensing Agency) and 676.607 (Agency responsibilities), the agency may adopt rules to recognize specialties within a regulated field of practice subject to the authority of the boards, councils or programs listed in ORS 676.606 (Oversight and centralized service by agency) and may establish requirements for education, experience, examinations and supervision as necessary to ensure public safety and competency within the specialty.
